Het Openbaar Ministerie begint een procedure op verdenking van aanzetten tot geweld tegen Armeniërs
Den Haag, 14 september 2016 – Het Openbaar Ministerie (OM) heeft naar aanleiding van aangiftes vanuit de Armeense gemeenschap besloten een inwoner van Den Haag te verhoren op verdenking van een strafbaar feit, namelijk van het aanzetten tot geweld tegen Armeniërs. De verdenking is aldus het OM zodanig dat strafvervolging in de rede ligt. De Samenwerkende Armeense Organisaties, te weten de Federatie Armeense Organisaties Nederland (FAON) en het Nederlands Armeens Comité voor Rechtvaardigheid en Democratie (Hay Tad) die aangifte hebben gedaan, spreken van een belangrijke beslissing van het OM voor Armeniërs in Nederland en elders in de wereld.
De betrokken persoon heeft volgens het OM de grenzen van de vrijheid van meningsuiting overschreden door zijn optreden tijdens een demonstratie op 1 juni 2014 tegen het monument bij de Armeense Kerk in Almelo ter nagedachtenis aan de Armeense genocide. Met zijn uitlating “Karabach zal het graf van de Armeniërs worden” heeft hij volgens het OM strafbaar aangezet tot geweld tegen Armeniërs wegens hun ras en/of geloof.

Հաագա, 14 սեպտեմբերի 2016 թ. – Ի պատասխան հոլանդահայության ներկայացրած գանգատների Հոլանդիայի դատախազությունը որոշել է ունկնդրել Հաագայի բնակչին, որին կասկածում են հայերի նկատմամբ բռնություններ հրահրելու իրավախախտման մեջ։ Դատախազության կարծիքով պարագան այնպիսին է, որ տրամաբանորեն կհանգեցնի քրեական գործ հարուցելուն։ Համագործակցող Հոլանդահայ Կազմակերպությունները, ի դեմս Հոլանդահայ կազմակերպությունների ֆեդերացիայի (FAON) և Հոլանդիայի Հայ Դատի, որոնք հանցագործության դեմ գանգատ էին ներկայացրել, համարում են, որ Հոլանդիայի դատախազության որոշումը կարևոր քայլ է ոչ միայն հոլանդահայության, այլ համայն հայության համար։
Ըստ դատախազության մեղադրվող անձը խախտել է խոսքի ազատության սահմանները, երբ նա ելույթ է ունեցել 2014 թվականի հունիսի 1-ին Նիդերլանդների Ալմելո քաղաքում տեղի ունեցած թուրքական հանրահավաքում, որը ուղղված էր Ալմելոյի Հայ Առաքելական եկեղեցու հողամասում տեղադրված Հայոց ցեղասպանության զոհերի հուշահամալի դեմ։ Դատախազությունը համոզված է, որ նրա հայտարարությունը` «Ղարաբաղը լինելու է հայերի գերեզմանը» կարելի է համարել քրեական հանցագործություն, քանի որ դրանով իսկ նա հրահրում է բռնություն հայերի նկատմամբ` նրանց ցեղային և/կամ կրոնական պատկանելության պատճառով։

Dutch Public Prosecution Service initiates proceedings on suspicion of inciting violence against Armenians
The Hague, 14 September 2016 – In response to the reports from the Armenian community the Dutch Public Prosecution Service has decided to hear a resident of The Hague on suspicion of an offense, namely inciting violence against Armenians. According to the Public Prosecutor is the suspicion such, that the institution of criminal proceedings against him is reasonably to be expected. The Joint Armenian Organisations, namely the Federation of Armenian Organisations in the Netherlands (FAON) and Dutch Armenian Committee for Justice and Democracy (Hay Tad) who reported the offence, speak of a major decision of the Public Prosecution Service for Armenians in the Netherlands and elsewhere in the world.
According to the Public Prosecution Service the person concerned has violated the limits of freedom of expression speaking at a Turkish rally on 1 June 2014 against the Genocide memorial erected on the churchyard of the Armenian Apostolic Church in Almelo. According to the Public Prosecution Service, his statement “Karabakh will be the tomb of the Armenians” would be a criminal offence, since he is inciting violence against Armenians because of their race and/or religion.
