Switzerland. ECHR decided that the right of the freedom of expression of the Turkish ultranationalist <!--more Continue reading \/ \u0531\u0574\u0562\u0578\u0572\u057b\u0568 \u2192--> Dogu Perincek was restrained when the latter was found guilty of racial discrimination by a Swiss district court in 2007. The sentence was later confirmed by the Swiss Federal Court. Perincek has repeatedly denied the Armenian Genocide on his visits to Switzerland.<\/p>\n<p style=\"text-align: justify;\">In January 2015, by processing the request of Switzerland, the Grand Chamber of the European Court of Human Rights decided to refer the case for a review. Today ECHR passed a verdict on this case. Represented by international attorneys Geoffrey Robertson and Amal Clooney and Armenia\u2019s Prosecutor General Gevork Kostanyan, Armenia was included in the case as the third interested party.<\/p>\n<p style=\"text-align: justify;\">The judgement delivered at today\u2019s short morning session of the Court was important for the Armenian side due to several reasons, the most significant of which is the fact the ECHR ruled out a point previously stated by the Chamber of the Court. The latter had claimed that no parallels could be drawn between the Armenian Genocide and the Jewish Holocaust. The Chamber of the Court however did not possess the jurisdiction to issue such a decision.<\/p>\n<p style=\"text-align: justify;\">Another important point stated in today\u2019s decision is that no one has the right to meddle with the pain and dignity of Armenian people. According to the Court\u2019s decision the Armenian living in the territory of Europe has a right to dignity without restrictions.<\/p>\n<p style=\"text-align: justify;\">Robertson mentioned that today is an important day for Armenia and Armenians, as article 301 of the Turkish Constitution will be taken into focus and it should be eliminated, if Turkey wishes to become a member of the European family.<\/p>\n<p style=\"text-align: justify;\">It is also noteworthy that today\u2019s judgment concerns Perincek\u2019s announcements in Switzerland. The verdict of the ECHR does not question the fact of the Armenian Genocide. It also does not give green light to the future attempts of denial, which may be criminalized provided there is strong legislation .<\/p>\n<p style=\"text-align: justify;\">\u201cThe Court still leaves open other situations where one could punish an individual for denying the Armenian Genocide in certain circumstances. The Court noted that they were it was wrong to convict Perincek partly because there were no heightened tensions or special historical overtones in Switzerland. So one could conclude from the opinion that if there are situations where there are heightened tensions between Armenians and Turks because of the denial, than denial of the Armenian Genocide maybe
