About Switzerland’s Decision to Appeal the European Court of Human Rights Ruling<\/h2>\n

Yerevan (11 March 2014) \u2013 We welcome the Swiss Government’s decision to request that the December 17 decision of the European Court of Human Rights be referred to the Grand Chamber for review. By this decision Switzerland is attempting to defend its own legislation, while at the same time is adhering to the expectation of all Armenians to appeal the ECHR December 17 ruling, in order to create the opportunity to rectify the contentious assertions about the Armenian Genocide in that ruling. Of course, this process has several more stages to pass, first of which would be the the decision by the Grand Chamber on whether or not to accept the referral.<\/p>\n

The Armenian National Committees everywhere, along with other structures representing different segments of Armenians, had appealed to the Swiss authorities in order to make such a decision. Now, all the Armenian National Committees will concentrate their efforts on successfully passing all subsequent stages. This is an issue which requires pan-national consensus and exertion of all means in order to reach the desired result: rectification of the contentious assertions about the Armenian Genocide in the ECHR ruling.<\/p>\n

De acuerdo al comunicado emitido este martes 11 de marzo por la Oficina Federal de Justicia de Suiza, se conoci\u00f3 que apelar\u00e1 al Tribunal Europeo de Derechos Humanos (TEDH) y solicitar\u00e1 que env\u00ede el caso de Dogu Perin\u00e7ek a la Gran Sala del TEDH para que revea el fallo en primera instancia. Seg\u00fan la Oficina Federal, la apelaci\u00f3n tiene como objetivo \u201caclarar la competencia de las autoridades nacionales en la aplicaci\u00f3n de la disposici\u00f3n contra el racismo penal establecido en el C\u00f3digo Penal suizo (art. 261bis )\u201d. Dicha disposici\u00f3n penal hab\u00eda entrado en vigencia en 1995 \u201cpara acabar con las lagunas en el derecho penal y que el pa\u00eds pueda adherirse a la Convenci\u00f3n de la ONU sobre la Eliminaci\u00f3n de todas las Formas de Discriminaci\u00f3n Racial\u201d.<\/p>\n

Desde el Consejo Nacional Armenio entendemos que la apelaci\u00f3n de Suiza es fundamental para enfatizar lo que diversas organizaciones y referentes del campo de los derechos humanos de todo el mundo han se\u00f1alado: el fallo no defend\u00eda la libertad de expresi\u00f3n, sino que pon\u00eda en duda la existencia del genocidio contra los armenios. En este sentido, desde todas las delegaciones del CNA se propiciaron encuentros con las delegaciones diplom\u00e1ticas de la Confederaci\u00f3n Suiza para bregar por la apelaci\u00f3n, entendiendo que no s\u00f3lo vulneraba el derecho suizo sino que sentaba un precedente nefasto para la justicia y la reparaci\u00f3n a las v\u00edctimas del genocidio perpetrado por el Estado turco.<\/p>\n

Es por ello que, a partir de la apelaci\u00f3n, deben intensificarse los esfuerzos de todos aquellos que luchan por memoria, verdad y justicia para que la Gran Sala del TEDH comprenda el peligro que conlleva para la comunidad internacional sostener la visi\u00f3n negacionista, que avala los intentos del Estado turco de explicar el genocidio contra los armenios como una tragedia propia de la guerra, y no como un acto planificado y sistem\u00e1tico, del que el mundo tiene sobradas pruebas. A poco tiempo de cumplirse el centenario de su inicio, resulta de suma gravedad que un organismo europeo desconozca las posiciones hist\u00f3ricas de gran parte de los pa\u00edses de ese continente frente al genocidio.<\/p>\n

Berne. Switzerland is to request that the European Court of Human Rights have the case of Do\u011fu Perin\u00e7ek referred to the Grand Chamber for review. The decision was made by the Federal Office of Justice (FoJ). A review would clarify the scope available to the Swiss authorities in applying Swiss criminal law to combat racism.<\/p>\n

The European Convention on Human Rights provides for referral to the Grand Chamber in cases including those which raise a serious question affecting the interpretation or application of the Convention. In the present case, Switzerland’s primary interest is in clarifying the scope available to the domestic authorities in applying the criminal anti-racism provision laid down in the Swiss Criminal Code (Art. 261bis CC). Switzerland created this penal provision, which entered into force on 1 January 1995, to close loopholes in criminal law and enable the country to accede to the UN Convention on the Elimination of All Forms of Racial Discrimination.<\/p>\n

On 9 March 2007, Turkish national Do\u011fu Perin\u00e7ek was sentenced in Canton Vaud to both a financial penalty and a criminal fine under Art. 261bis CC for denying the Armenian Genocide. The Cantonal Court of Canton Vaud and the Federal Supreme Court both rejected appeals against the judgment. In its ruling of 17 December 2013, the competent chamber of the European Court of Human Rights determined that the Swiss courts’ rulings violated the appellant’s right to freedom of expression.<\/p>\n
