Den Haag\/Almelo, 17 maart 2017 \u2013 Vandaag heeft de rechtbank in Almelo de voorzitter van de Turks-Azerbeidzjaanse Culturele Vereniging in Den Haag veroordeeld wegens aanzetten tot geweld tegen Armeni\u00ebrs. De Armeense gemeenschap, met name het Nederlands Armeens Comit\u00e9 voor Rechtvaardigheid en Democratie (Hay Tad) en de Federatie Armeense Organisaties Nederland (FAON) zijn blij met de uitspraak, omdat hiermee de agressie jegens de Armeense minderheid van Turks-Azerbeidzjaanse kant een halt wordt toegeroepen.<\/p>\n

De rechtbank heeft hierbij een hogere straf opgelegd dan de officier van justitie had ge\u00ebist, namelijk 120 uur taakstraf en een voorwaardelijke gevangenisstraf van \u00e9\u00e9n maand met een proeftijd van 2 jaar. De officier van justitie had 80 uur werkstraf en twee weken voorwaardelijke gevangenisstraf met een proeftijd van 2 jaar ge\u00ebist.<\/p>\n

De hogere straf is volgens de rechter op zijn plaats gezien de ernst van het feit en de manier waarop het is gebeurd. Hij verwees o.a. naar het feit dat de betrokkene achter zijn woorden staat en geen inzicht had getoond. Ook is er het gevaar van recidive.<\/p>\n

De man werd vervolgd, omdat hij tijdens een Turkse demonstratie heeft gescandeerd: \u201cKarabach zal het graf van de Armeni\u00ebrs worden\u201d, waarna een menigte van een paar duizend man deze zin herhaalde.<\/p>\n

Zoals bekend heeft op 1 juni 2014 een Turkse demonstratie plaatsgevonden in Almelo, gericht tegen het monument op het terrein van de Armeense Kerk aldaar, ter herdenking van de slachtoffers van de Armeense genocide in 1915. Wegens die uitlatingen tijdens deze demonstratie is er vanuit de Armeense gemeenschap aangifte gedaan, m.n. door het Nederlands Armeens Comit\u00e9 voor Rechtvaardigheid en Democratie (Hay Tad) en de Federatie van Armeense Organisaties in Nederland (FAON).<\/p>\n

The Hague\/Almelo, 17 March 2017 \u2013 Today the Court in Almelo convicted the chairman of the Turkish Azerbaijani Cultural Association in The Hague for inciting violence against Armenians. The Armenian community in the Netherlands, namely the Dutch Armenian Committee for Justice and Democracy (Hay Tad) an the Federation of Armenian Organisations in the Netherlands (FAON) welcomes the verdict, as it puts a halt to the aggression against the Armenian minority in the Netherlands and elsewhere.<\/p>\n

The court decided to convict the man with a more severe punishment than the prosecutor had demanded. Namely, 120 hours of community service and one month of suspended imprisonment with a probation of 2 years. The prosecutor demanded 80 hours of community service and a suspended imprisonment of 2 weeks with a probation of 2 years.<\/p>\n

The more severe punishment is necessary according to the court, because of the seriousness of the fact, and the way that it occurred. He referred also to the fact that the man stands with his statement and did not show any insight in the case. Furthermore, there is a danger of recidivism.<\/p>\n

He is prosecuted for having chanted: \u201cKarabakh will be the grave of the Armenians\u201d during a Turkish rally in Almelo.<\/p>\n

As previously announced, on 1 June 2014 a Turkish demonstration took place in Almelo, against the Genocide memorial erected on the churchyard of the Armenian Apostolic Church in that city. EAFJD hails the verdict against author of anti-Armenian calls<\/strong><\/p>\n

The European Armenian Federation for Justice and Democracy (EAFJD) hails the verdict of the Court of the Netherlands against Ilham Ashkin, chairman of the Turkish-Azerbaijani cultural union in The Hague. \u201cArmenpress\u201d reports Chairman of the Committee Kaspar Karampetian made a announcement over that, \u201cThe announcement \u201cKarabakh will be the grave of Armenians\u201d has no place in Europe, in the Netherlands. It\u2019s a clear message to those who advocate violence and hatred in Switzerland, Netherlands or elsewhere. We have to be cautious over this issue. No Azerbaijani or Turk can make such anti-Armenian calls under the pretext of freedom of speech. Holanda: Condenan a un turco-azer\u00ed que amenaz\u00f3 a los armenios
\nUna sentencia ejemplar que marca l\u00edmites<\/strong><\/p>\n

(DIARIO ARMENIA) La amenaza proferida a los armenios por el presidente de la Asociaci\u00f3n Cultural turco-azer\u00ed de Holanda Ilham Askin le cost\u00f3 una condena sin precedentes de los tribunales de La Haya. Su discurso pleno de odio y violencia contra los armenios hab\u00eda tenido lugar durante un mitin pol\u00edtico de la comunidad turca el 1\u00b0 de junio de 2014 en la localidad de Almelo, ciudad ubicada al oeste de los Pa\u00edses Bajos.<\/p>\n

\u201cKarabagh ser\u00e1 la tumba de los armenios\u201d, profer\u00eda entonces Askin que con un mensaje con el buscaba enfervorizar a los centenares de turcos que participaban del acto pol\u00edtico en contra de la instalaci\u00f3n del Memorial del Genocidio Armenio erigido en las inmediaciones de la Iglesia Apost\u00f3lica Armenia de esa ciudad.<\/p>\n

Producido el hecho, la colectividad armenia present\u00f3 una denuncia a la justicia holandesa a trav\u00e9s de la Federaci\u00f3n de Organizaciones Armenias de los Pa\u00edses Bajos (FAON) y la Federaci\u00f3n Euro-Armenia para la Justicia y la Democracia (FEAJD \u2013 Consejo Nacional Armenio).<\/p>\n

La audiencia, que tuvo lugar el pasado 3 de marzo, se prolong\u00f3 por varias horas y se desarroll\u00f3 con presencia de numerosos armenios y turcos, concitando el inter\u00e9s de los medios de prensa holandeses, armenios y turcos. Durante la misma se present\u00f3 como prueba el video donde Askin repet\u00eda una y otra vez que \u201cKarabagh ser\u00eda la tumba de los armenios\u201d y una multitud enardecida repet\u00eda sus consignas.<\/p>\n

En su declaraci\u00f3n, Askin dijo que sus declaraciones no pod\u00edan ser consideradas un delito y que se refer\u00edan a una regi\u00f3n espec\u00edfica donde debido a la guerra existente seguramente la actual situaci\u00f3n se traducir\u00eda en un derramamiento de sangre. Reiter\u00f3 que no hab\u00eda hecho nada malo y asegur\u00f3 que no ten\u00eda motivos para arrepentirse de sus manifestaciones.<\/p>\n

El fiscal interviniente en la causa fundament\u00f3 la denuncia y solicit\u00f3 se dictar\u00e1 la culpabilidad de Ilham Askin y se lo condenara a cumplir 80 horas de servicio comunitario y una pena de prisi\u00f3n en suspenso de quince d\u00edas, durante un per\u00edodo a prueba de dos a\u00f1os. Al finalizar su alegato, el representante p\u00fablico manifest\u00f3 que era necesario un fuerte mensaje de la justicia para evitar la reiteraci\u00f3n de estos hechos de violencia dial\u00e9ctica.<\/p>\n

Llamativamente, el tribunal interviniente decidi\u00f3 aplicar un castigo mayor al solicitado por el fiscal y conden\u00f3 a Askin a 120 horas de servicio comunitario y un mes de prisi\u00f3n condicional con el per\u00edodo a prueba de dos a\u00f1os.<\/p>\n

Conocida la sentencia, la Federaci\u00f3n Euro-Armenia para la Justicia y la Democracia acogi\u00f3 con satisfacci\u00f3n el veredicto ya que pone l\u00edmites a la permanente agresi\u00f3n verbal que sufren la minor\u00edas armenias de Holanda y otros pa\u00edses de la regi\u00f3n por parte de los fundamentalistas turcos y azer\u00edes.<\/p>\n

\u201cDamos la bienvenida a esta decisi\u00f3n de la corte holandesa de castigar a Ilham Askin debido a la gravedad del delito cometido y en la forma y contexto en que se produjo. Cantos como \u201cKarabagh ser\u00e1 la tumba de los armenios\u201d no pueden tener lugar en los Pa\u00edses Bajos. \u00c9ste es un mensaje claro para aquellos que fomentan la violencia y el odio, sea aqu\u00ed, en Suecia o en otros lugares. Vamos a estar muy atentos a este respecto\u201d, dijo Kaspar Karapetian, presidente de la Federaci\u00f3n Euro-Armenia para la Justicia y la Democracia (FEAJD).<\/p>\n
