Den Haag, 3 maart 2017 \u2013 Vandaag vond in Almelo de inhoudelijke behandeling plaats van de rechtszaak tegen de heer Ilham Askin, voorzitter van Turks-Azerbeidzjaanse Culturele Vereniging in Den Haag. De heer Askin wordt vervolgd wegens het doen van discriminatoire uitlatingen jegens Armeni\u00ebrs, omdat hij tijdens een Turkse demonstratie heeft gescandeerd: \u201cKarabach zal het graf van de Armeni\u00ebrs worden\u201d. Hiermee heeft hij, aldus het OM, opgeroepen tot geweld, subsidiair een groep mensen wegens hun Armeense afkomst beledigd.<\/p>\n

Zoals bekend heeft op 1 juni 2014 een Turkse demonstratie plaatsgevonden in Almelo, gericht tegen het monument op het terrein van de Armeense Kerk aldaar, ter herdenking van de slachtoffers van de Armeense genocide in 1915. Wegens de uitlatingen tijdens deze demonstratie is er vanuit de Armeense gemeenschap aangifte gedaan, m.n. door het Nederlands Armeens Comit\u00e9 voor Rechtvaardigheid en Democratie<\/a> (Hay Tad) en de Federatie van Armeense Organisaties in Nederland (FAON).<\/p>\n

Gedurende de twee uur durende zitting, die werd bijgewoond door vele ge\u00efnteresseerden van zowel Armeense als Turkse afkomst, alsmede door Nederlandse, Armeense en Turkse media, werd een video-opname van de demonstratie vertoond, waarop te zien is hoe de heer Askin de woorden \u201cKarabach zal het graf van de Armeni\u00ebrs worden\u201d meerdere malen scandeert, en waarin een menigte van paar duizend man deze zin herhaalt.<\/p>\n

De heer Askin, bijgestaan door advocaat Plasman, beantwoordde vragen van de rechter en de officier van justitie door te zeggen dat hij zijn uitingen niet beschouwt als strafbaar. Hij noemde in zijn uitspraken een specifiek gebied, waar door de huidige situatie mogelijk een oorlog zal uitbreken en bloed zal vloeien. Hij is van oordeel dat hij niets fouts heeft gedaan en, desgevraagd, gaf hij aan er geen spijt van te hebben.<\/p>\n

Het Openbaar Ministerie gaf uitgebreid uitleg over het gedane onderzoek en motiveerde de strafeis van 80 uur werkstraf en 2 weken voorwaardelijke gevangenisstraf met een proeftijd van 2 jaar, met de noodzaak een sterk signaal af te geven. Ook werd in aanmerking genomen dat de heer Askin geen inzicht heeft getoond en er gevaar voor recidive is.<\/p>\n
