ՊՐԻՒՔՍԵԼԻ ՄԷՋ ՄԱՄԼՈՅ ԱՍՈՒԼԻՍ ՄԵԾԻ ՏԱՆՆ ԿԻԼԻԿԻՈՅ ԿԱԹՈՂԻԿՈՍՈՒԹԵԱՆ ՄԱՐԴԿԱՅԻՆ ԻՐԱՒԱՆՑ ԵՒՐՈՊԱԿԱՆ ԴԱՏԱՐԱՆԻՆ ՄՕՏ ԲԱՑԱԾ ԴԱՏԻՆ ԱՌԻԹՈՎ

Պրիւքսել, 7 դեկտեմբեր, 2016.- Նախաձեռնութեամբ Մեծի Տանն Կիլիկիոյ կաթողիկոսութեան եւ կազմակերպութեամբ ՀՅԴ Եւրոպայի Հայ դատի յանձնախումբին, այսօր յետմիջօրէին Պելճիքայի մայրաքաղաք Պրիւքսելի մամլոյ ակումբին մէջ տեղի ունեցաւ մամլոյ ասուլիս մը, Մեծի Տանն Կիլիկիոյ կաթողիկոսութեան Մարդկային իրաւանց եւրոպական դատարանին (ՄԻԵԴ) մօտ բացած դատին առիթով, որուն նպատակն է պահանջել՝ Սիսի պատմական կաթողիկոսարանի վերադարձը:

Մամլոյ ասուլիսին մասնակցեցան եւ դատավարութեան ընթացքը ներկայացուցին կաթողիկոսարանի իրաւական խումբին անդամներէն երեքը՝ դոկտ. Փայամ Ախաւան, դոկտ. Նորա Պայրաքտարեան եւ դոկտ. Թենի Սիմոնեան: Ն.Ս.Օ.Տ.Տ. Արամ Ա. Կաթողիկոսի ողջոյնի խօսքը փոխանցեց Գերշ. Տ. Գեղամ Արք. Խաչերեան, իսկ մամլոյ ասուլիսի բացումը կատարեց ՀՅԴ Եւրոպայի Հայ Դատի յանձնախումբի նախագահ Գասպար Կարապետեանը:

Ասուլիսին ներկայ գտնուեցան միջազգային եւ տեղական լրատուական միջոցներու ներկայացուցիչներ, եւրոերեսփոխաններ, պելճիքացի երեսփոխաններ, ոչ-կառավարական կազմակերպութիւններու ներկայացուցիչներ, իրաւաբաններ եւ տեղւոյն հայ համայնքի ներկայացուցիչներ:

Վեհափառ Հայրապետին ողջոյնի խօսքին մէջ նշուած էր՝ «այս դատը պատմական դատ մըն է, որ Հայկական Ցեղասպանութենէն 100 տարիներ անց Մեծի Տանն Կիլիկիոյ Կաթողիկոսութիւնը կը բանայ թուրք պետութեան դէմ, պահանջելով իր պատմական նստավայրին վերադարձը»:

Իր կարգին, Գասպար Կարապետեան, ՀՅԴ Եւրոպայի Հայ Դատի յանձնախումբի նախագահը, կարեւորեց նման դատի մը նախաաձեռնութիւնը, որ ինքնին պերճախօս վկայութիւն մըն է, թէ մեր դատը ճանաչումէ անցած է հատուցման փուլին: Այսօրուան կայացած մամլոյ ասուլիսը կարեւոր է այն առումով՝ որ Պրիւքսելը ըլլալով Եւրոպական միութեան կեդրոնատեղին, արդէն փաստ մըն է, որ բարձրագոյն ատեաններուն առջեւ հայը կը հետապնդէ իր դատը:

Կաթողիկոսարանի իրաւաբաններու յանձնախումբի հիմնական փաստաբաններէն դոկտ. Փայամ Ախաւան շեշտեց, որ այս դատը հիմնուած է երկու կարեւոր սկզբունքներու վրայ, որոնք են՝ կալուածի վերադարձը իր իրաւատիրոջ եւ ազատ պաշտամունքի իրաւունքը, որոնք նաեւ Թուրքիոյ փոքրամասնութիւններու պարագային՝ պաշտպանուած են Լոզանի դաշնագրով: Ախաւան նաեւ նշեց, որ Թուրքիոյ իշխանութիւնները պէտք է խոհեմ գտնուին, եւ վերադարձնեն կալուածը: Ան վստահեցուց թէ, դատը իրաւական եւ պատմական ամուր հիմնաւորումներով ներկայացուած է դատարան:

Դոկտ. Նորա Պայրաքտարեան իր կարգին անդրադարձաւ մինչ օրս դատական գործընթացին, շեշտելով, թէ՝ Հայկական Ցեղասպանութիւնը անուրանալի փաստ մըն է, եւ Թուրքիան պարտաւոր է առերեսուիլ իր անցեալին հետ, ինչ որ նաեւ կը նշուի Եւրոմիութեան եւ եւրոպական երկիրներու բանաձեւներուն մէջ:

Դոկտ. Թենի Սիմոնեան ներկայացուց դատին նախապատրաստական աշխատանքները, եւ ընդգծեց, թէ այս դատը առիթ մը պիտի հանդիսանայ Թուրքիոյ մէջ գտնուող, բռնի իսլամացուած միլիոնաւոր թաքուն հայերուն վերագտնելու համար իրենց պատկանելիութիւնը եւ վերադառնալու իրենց հայկական արմատներուն:

Ներկայացումներուն աւարտին, ներկաներուն առիթը տրուեցաւ որ կաթողիկոսարանի իրաւական յանձնախումբի անդամներուն ուղղեն իրենց հարցումները, յաւելեալ մանրամասնութիւններ ստանալու համար: Նշենք նաեւ, որ մամլոյ ասուլիսը դիմատետրի (ֆէյսպուք) ճամբով ուղիղ հեռարձակուեցաւ եւ շատեր նաեւ այս ճամբով իրենց հարցումները ուղղեցին:

Cilicia Catholicosate Files Appeal in European Court

(source: EAFJD press release, ARMENIAN WEEKLY) On December 7, the Armenian Catholicosate of Cilicia officially filed the application to reclaim the historical headquarters of the Holy See of the Great House of Cilicia from Turkey to the European Court of Human Rights (ECHR).

Following its submission, a press conference took place, which featured European Armenian Federation for Justice and Democracy (EAFJD) President Kaspar Karampetian, Representative of Catholicos Aram I Archbishop Kegham Khatcherian, professor of international law Nora Bayrakdarian, Catholicosate team coordinator and adjunct professor of religion and ethics Teny Pirri-Simonian, and international lawyer and professor at McGill University Payam Akhavan. Journalists from local, and international media, members of the European Parliament, Belgian members of Parliament, NGO representatives, lawyers and representatives of the Armenian community of Belgium attended the conference.

In his opening remarks EAFJD President Kaspar Karampetian highlighted the importance of the Catholicosate’s initiative which he mentioned is a crystal clear indication that the Armenian Cause has moved from the stage of recognition to that of demand for reparation. Furthermore Karampetian pointed out that the fact of the press conference taking place in Brussels, the administrative center of the European Union, proves that the Armenian nation pursues its lawful rights to supreme tribunals.

Catholicos Aram I in his message that was conveyed by Archbishop Khatcherian called the legal action against Turkey historical since it comes a 100 years after the Genocide of the Armenians.

Dr. Payam Akhavan discussed the importance of the claim and how the case was about the property rights of the church and the right of religious worship. “[The case] entails the right of the church to restore ownership, possession, use, and restoration of the monastery for the purposes of religious worship,” Akhavan said in his address.

Akhavan said that the case was inspired by the 2011 conciliatory remarks made by the Turkish government, which invited religious minorities to return to Turkey. These comments encouraged Aram I to send a letter in 2011 and 2013 demanding to return the estates of the Sis Catholicosate, however the letters remained unanswered.

A case was then filed to the Constitutional Court of Turkey, however the court decided not to proceed with the case and banned the church from having access to property records. Pakhavan explained how the current status of the property was just a pile of rubble, but if given under the right ownership, could become a cultural attraction and a center for religious worship in the Middle East. “Anticipation will take several months. We have waited 100 years, and are willing to wait several months more for justice,” said Pakhavan.

Dr. Nora Bayrakdarian spoke about the procedure of the case and underlined that the Armenian Genocide is an indisputable fact adding that Turkey must confront its past, an urge that is also included in the relevant resolutions adopted by the European Parliament and European states.

Meanwhile, Dr. Pirri-Simonian addressed two significant attributions of the case, which included its value of promoting multiculturalism and inter-religious dialogue in the Middle East and encouraging Islamized Armenians to come forward and reveal who they are.

Following the remarks by the distinguished speakers, a variety of questions were asked regarding the precedence the case can set for other minorities; whether this will contribute to the political game between the European Union and Turkey; and if the council was prepared to accept a ruling from the court that did not fully comply with their expectations.

Pakhavan said that given their arguments, he would be very surprised if the court denied the right to the possession and use of the property. “The main claim is property rights under Article 1 of Protocol 1 to the European Convention and the supplementary claim is to the right of religious worship… I would be very surprised if the European Court of Human Rights would say that we are going to deny the right of the Christian minority, which has specific rights under the Lausanne treaty to go to a place of worship,” said Pakhavan.

Several other factors, including the current election going on for a Patriarchate in Istanbul, details into property rights, and the lasting impact it could have in the Middle East were discussed as well.

The press conference was live streamed on the EAFJD and Cilicia TV facebook pages which viewers used in order to address their questions online.

Le Catholicossat de Cilicie engage la procedure officielle en vue de la restitution de son siège historique en Turquie

(Nouvelles d’Arménie) Le 7 décembre, le Catholicossat arménien de Cilicie a lancé officiellement la procédure auprès de la Cour européenne des droits de l’homme (CEDH) en vue de se voir restituer le siège historique de la Grande Maison de Cilicie situé sur le territoire de l’actuelle Turquie. Le dépôt de la procédure a été suivi d’une conférence de presse, animée par le président de la Fédération arménienne européenne pour la justice et la démocratie (FAEJD), Kaspar Karampetian, le représentant du Catholicos de Cilicie Aram I, l’archevêque Kegham Khatcherian, la professeure en droit international Nora Bayrakdarian, le coordinateur de l’équipe du Catholicossat et maître de conférences en religion et morale Teny Pirri-Simonian, ainsi que le juriste international et enseignant à la McGill University, Payam Akhavan.

Après que l’archevêque Khatcherian a lu le message adressé par le Catholicos depuis le Saint Siège d’Antelias, au Liban, P. Akhavan a pris la parole pour souligner l’importance d’une telle demarche, qui en appelle aux droits de l’Eglise sur ses propriétés mais aussi à la liberté de culte. “[Ce dossier] en appelle au droit de l’Eglise à la propriété, l’usage, la restauration du monastère et le retour au culte de celui-ci”, a déclaré notamment P. Akhavan. Il a par ailleurs rappelé que la démarche avait été encouragée par les propos conciliants tenus en 2011 par le gouvernement turc, qui avait alors invité les minorités religieuses à retourner en Turquie. De telles déclarations avaient encouragé Aram I à envoyer une lettre en 2011 et en 2013 demandant le retour des biens dépendant du Catholicossat de Sis, le siège historique en Cilicie ; mais ces lettres sont restées sans réponse. La décision avait été alors prise d’en appeler à la Cour constitutionnelle de Turquie, mais cette dernière a adressé une fin de non recevoir à la demande du Catholicossat de Cilicie, qui s’est vu interdire l’accès aux archives er registres relatifs à ses biens et propriétés.

P. Akhavan a rappelé que si le site actuel est en ruines, il pourrait, s’il était restitué à son propriétaire légitime, devenir un centre culturel et religieux d’importance majeure pour tout le Moyen Orient. “Nous avons attendu un siècle, et nous pouvons attendre encore des mois s’il le faut pour obtenir justice”, a ajouté Pakhavan dans une allusion à la durée de la procédure. De son côté, le Dr. Pirri-Simonian a exposé d’autres aspects de cette initiative, visant à promouvoir le multiculturalisme et le dialogue inter-religions au Moyen Orient mais aussi à encourager les Arméniens islamisés à révéler leurs origines, un processus qui s’est d’ailleurs intensifié ces dernières années. Cette affaire intervient toutefois sur fond de tensions entre la Turquie et l’Union européenne, comme n’ont pas manqué de le souligner les orateurs, qui se montrent néanmoins confiants quant à son issue. Même si l’Europe cherche à ménager Ankara, il serait surprenant que la Cour européenne dénie le droit à la propriété du requérant, a souligné Pakhavan qui a précisé : “La demande principale relève des droits à la propriété en vertu de l’Article 1 du chapitre 1 de la Charte européenne, et l’autre demande relève du droit à la liberté religieuse… Je serai vraiment étonné que la Cour européenne des droits de l’homme décidait de récuser les droits de la minorité chrétienne qui dispose de droits spécifiques, et singulièrement religieux, en vertu du Traité de Lausanne.
